Battling ObamaCare


When Missouri voters attempted to stop ObamaCare at the ballot box via the initiative process, the national news media took notice. In the August 3 vote, 7 in 10 voters in the “Show Me State” supported Proposition C, which overturns government mandates requiring health insurance. Proposition C actually bars penalties against people who pay their own health bills without insurance.

On August 2, U.S. District Judge Henry E. Hudson ruled against a U.S. Justice Department request to throw out a lawsuit brought by Virginia against ObamaCare. Virginia is arguing in the lawsuit that the U.S. Congress had unconstitutionally exceeded its powers by forcing individuals to buy insurance.

Hudson wrote, “While this case raises a host of complex constitutional issues, all seem to distill to the single question of whether or not Congress has the power to regulate — and tax — a citizen’s decision not to participate in interstate commerce…”

Hudson continues by saying there is, “some authority arguably supporting the theory underlying each side’s position.” Hudson’s decision sets up the opportunity to have appellate and eventually the Supreme Court decide these issues.

But our personal favorite of the many lawsuits challenging ObamaCare is from Arizona. Yes, the land of immigration enforcement could also be the site of a major constitutional battle about ObamaCare. The citizens of Arizona are restless with their Washington, D.C. overseers.

The Goldwater Institute, a public policy outfit named for Arizona’s most famous son, is taking a different swing at the question.

    I know members of Congress view the Constitution as just a piece of paper, but how can the government require me to buy a product or service?

    I don't think even of the Republicans win both houses with a signifivant majority that it will get repealed, because there are too many RINOs like John McCain and Olympia Snow, who just want to get along with the Democrats and get good press from the MSM.

    If you don't like John McCain, please support former Congressman J.D. Hayworth. He's running hard to defeat MCain in the Republican primary on August 24.
    He can win, but needs every vote and every $ contribution.

    Watch out …..if the obamacare issue ever gets to the Supreme Court. Obama just picked and the Senate approved two of the worst possible people to ever have sitting on the highest court in the land, he, "Obama" will/is destroying this nation. He simply has to be removed…..

      Yes, he must be removed, the qestion is how? Impeachment? Nah. Tried that w/Clinton. Corruption charges? Why is he being "tolerated"? How did he rise so fast? Is Obamoa the front man for someone or something. He of the silver tongue has a legion of followers. Many work for him in the WH. Behind his broad, flashy smile lies something hidden and dark. He is an enemy of the Lord. God will not be mocked. The question is how long will it take for God to act and how many will die as we wait for God's hand to strike. History tells us evil men fall but they take millions with them. Nothing new under the sun. Obamoa and his legions come from a long line of . . . . . . . you fill in the blank.

    No , it will not be repealed . That's a pipedream .Americans know that when a bloody aspirin , that is one bloody aspirin in a hospitol , cost the insurance companies $140 , patients are routinely overbilled , to the tune of 1 TRILLION DOLLARS a year , that something needs fixing ….and so far all the Republicans/Conservatives can come up with , is " whining for repeal " .
