“The Court is dismayed by Cooper Union’s suggestion that the Jewish students should have hidden upstairs or left the building,” Judge John Cronan wrote, blasting the Manhattan college’s bid to dismiss a lawsuit by Jewish students who were trapped in the library by a mob of terrorist supporters. “These events took place in 2023—not 1943—and Title VI places responsibility on colleges and universities to protect their Jewish students from harassment, not on those students to hide themselves away in a proverbial attic.”
The strong language in the ruling was similar to how Judge Mark Scarsi had criticized UCLA.
“In the year 2024, in the United States of America, in the State of California, in the City of Los Angeles, Jewish students were excluded from portions of the UCLA campus because they refused to denounce their faith,” Judge Scarsi wrote in response to the university’s complicity in Hamas supporters setting up checkpoints and encampments to harass Jews.
The two federal judges who spoke forthrightly in defense of Jewish students had two things in common: both were conservatives associated with the Federalist Society.
And both men had been nominated by Trump.
To fully appreciate the moral courage of Judge Scarsi and Judge Cronan, compare them to their colleagues who had been nominated by Bill Clinton and Barack Obama.
When Jewish students at Harvard and MIT turned to Judge Richard Stearns, a Clinton nominee, he dismissed the MIT lawsuit entirely, claiming that MIT had not reacted “in a clearly unreasonable manner”, and dismissed the lawsuit charging that Harvard had discriminated and retaliated against Jewish students, but allowed the lawsuit accusing the university of maintaining a “hostile educational environment” to move forward.
He did concede that, “Harvard failed its Jewish students.”
Judge Fernando Olguin, an Obama appointee, however sneeringly dismissed a complaint by Jewish parents and students against the antisemitic Los Angeles ‘ethnic studies curriculum, claiming that he could not understand it. Olguin, who had worked for the Mexican American Legal Defense and Educational Fund, a proponent of ethnic studies curriculums, proved to be one of the most unsympathetic judges yet.
In Pennsylvania, Judge W. Scott Hardy, a Trump appointee, refused a request by Carnegie Mellon to dismiss a lawsuit by a Jewish student who had been harassed by a professor over her Jewishness and Israel’s war on terror, upholding an allegation of “deliberate indifference” against the university.
Judge Haywood Gilliam, Jr, an Obama appointee, however showed outright skepticism of a lawsuit against the California College of the Arts in San Francisco brought by a Jewish professor who had been put through the wringer at her school for challenging Students for Justice in Palestine’s pro-terrorist student activists.
Judge Gerald Austin McHugh Jr, another Obama appointee, dismissed a complaint by Jewish students against Haverford College, mocking it as a collection of “every frustration and disagreement of Jewish students and faculty” that “reads more as an opinion editorial’ and tipping his ideological hand, accused them of strategically “seeking to blur the line between Zionism as a political philosophy and Zionism as a component of Jewish identity, and in the process implicitly sweep any and all criticism of Israel into the basket of antisemitism.”
The handling of lawsuits filed by terrorist supporters also varied wildly by federal judges.
Judge Peter Messitte, a Clinton nominee who had worked in Yemen, issued a preliminary injunction requested by CAIR, which had supported the attacks of Oct 7, to allow a pro-terrorist event on Oct 7. Messitte, now deceased, had also insisted on blocking a Trump order during his first term allowing local officials to stop terrorist refugee resettlement in their communities.
By contrast, Judge Mitchell S. Goldberg, a Bush appointee, had rejected a lawsuit by the Faculty for Justice in Palestine group against the University of Pennsylvania trying to force the university not to cooperate with a congressional investigation of campus antisemitism.
In Texas however, Judge Robert Pitman, an Obama nominee and the “first openly gay judge” in the Fifth Circuit, backed a lawsuit by CAIR and Students for Justice in Palestine, a campus hate group whose chapters cheered the Oct 7 attacks, against Gov. Abbott’s antisemitism policies.
And back in California, Judge James Donato, an Obama appointee who had waged a judicial war against the Trump administration, allowed pro-terrorist activists to help defend the University of Berkeley against Jewish students alleging campus antisemitism.
While much has been written about the direct actions by the Trump administration on behalf of Jewish students, President Trump’s judicial appointments are playing a significant role in challenging campus antisemitism. The moral clarity brought by Judge Scarsi redefined how judges could speak directly and succinctly about the state of hate on college campuses.
And Judge Cronan’s equally strong and forthright words show that is becoming the new norm.
Meanwhile the behavior of Obama appointees like Messitte, Olguin and Pitman show the other side of the equation, and what the stakes are for American Jews in federal judicial appointments. Trump appointees have stood up for the civil rights of Jewish students while Obama appointees, true to their president’s policy, have enabled campus antisemitism.
Democratic Jewish groups have warned about the alleged ‘extremism’ of President Trump’s judicial appointments and championed confirming Biden’s extremist judicial appointees..
“We urge the Senate to confirm President Biden’s judicial nominees and fill all 44 judicial vacancies before Trump and the GOP return to power,” the Jewish Democratic Council of America had pleaded.
That included Adeel Abdullah Mangi, who had served on a think tank that had promoted Islamic terrorist figures, calls for BDS and “vile antisemitic propaganda”. By contrast, fourteen conservative judges, most appointed by Trump, visited Israel after Oct 7.They included Judge Lee Rudofsky, a Trump appointee who had warned that he would reject any law clerks that supported Hamas.
Are American Jews better off with Judge Rudofsky or with Mangi on the bench?
All of the Obama Appointed Judges should be totally removed from the Bench and lawsuits against those Anti Semites proceed and make Violent Ham-A** and Islamic Radicals Pay Big Time
I would check all of the possible memberships, and/or connections to, THE ACLU AND NLG!
THE ACLU has been advertising on FB that they will challenge Trump of all of EOs which means they have the Judges already lined up, their “unconstitutional” claims whether they are or not, which then takes years to hear the cases, therefore stopping everything he does. I don’t recall them having the same Ads for Obama and Biden?
The ACLU is quick to defend the protesters Right to Destroy and their Free Speech, but they never defend the likes of David Horowitz, and other FPM authors, and their Free Speech on the same campuses. They’ll label that Hate Speech and not of representation as if “from the river to the sea” is not Hate Speech and calling for the “wiping Israel off the map” killing millions!
We can imagine how far the antisemitic thinking will go because we’ve seen the documentaries of how far it has gone in the past. It was insane. It still is insane. That kind of thinking doesn’t get better with time. There is no kind, gentle version of Fascism.

To me it isn’t about the intricacies of faith or even politics as to how we are governed but simply the tried and true motto of ” Truth Justice and the American Way”. When I read a “Trump” judge rule in favor of the U S Constitution it isn’t political. It is just confirmation of the law. That is all Trump wants and it is all true Americans want.

This really should be worthy to FIGHT IN THE STREETS! Our campus takeover by radicals began during Vietnam with those protesters becoming teachers and professors, then administrators, all in the ’80s, who only hired their own which resulted in today’s complete takeover of our educational system, even starting in pre-school and Sesame Street!
We see videos of Jihadists, Hamas, Hezbollah, terrorists, teaching their young to “kill the Jew pigs!” What’s the difference with our radicals BRAINWASHING to do the same to JEWS, MAGAS, CONSERVATIVES, PRO-LIFE ETC….? When the bullet missed and the man in the bushes was caught, these radicals were sad and even angry since those two could have saved our Democracy!
Then you have Jeffries calling on his Army to “fight in the streets.” Wasn’t Trump impeached because of the word, “fight”? Trump’s was taken out of context, Jefferies, and others, really mean it!
All this rhetoric makes all campuses A HOSTILE LEARNING ENVIROMENT!
(I recently went to UNM’s Turning Point student meeting. They said they knew Jews who were in fear of being outed and then attacked. One architecture student said his professor was lecturing on MAGAS and Trump.
At a Welcome Back Days back in August, TP had a chart. “Which system in better: CAPITALISM OR SOCIALISM?” Students then just put a mark on their choice. About 80% went for Socialism. I saw a student who marked Socialism, and I said Cuba was very good at it. “Would you move there?” “Yes.” Me: “I know you like Free and Firsts so I’ll give you FREE plane ticket to Key West, some FREE innertubes, so you can be the FIRST to float TO Cuba, a Socialist Paradise? When do you want to go leave?” He walked away. Typical!)
The first thing I think of when hearing about these advocates for socialism: ‘You go first.’
Why is it we never hear about a mass exodus to Venezuela, China, N. Korea? Or even a small plane full of true believers? Because they are full of shit, that’s why. They would be crying to come home to mommy after 3 days in their perceived paradise.
An actual, out of the closet, member of the Communist Party USA was passing around flyers at UNM that the Party would pay for bus tickets to Canada if Trump won in 2016. He wins then the Commie was at UNM on the large commons area screaming that out. No one paid attention to him.
I met Paul years earlier when he was promoting the CPUSA with flyers. “Free Country.” I went up to him and I spoke Commie since I had been to countless of their meetings starting in the 80s. I spoke just like one. A younger man who was doing the same came over thinking I was a threat. Paul said I was “a Friendly.”
When I saw Paul on the commons, I went up to him and said, “YOU FIRST! YOU FIRST!” Haven’t seen him since so maybe he really did move there. Still can’t understand why he wouldn’t move to Cuba or Nicaragua.
I wonder if theres some action possible against judges who condone what is immoral, such as not protecting Jews/Jewish students. Comparing similar cases brought by other groups, Blacks, disabled etc. could be a start, maybe. I don’t think the founders, or anyone decent, wanted a system where the merits of a case depend 0n who appointed the judge. And the nation must decide if it wants to be like Nazi Germany and Muslim nations in its lack of rights and protections for Jews/Jewish students.. And have that decision as the measure for all cases and own it as a reflection of the morality of this nation,

If at all possible, the wrong decisions should be appealed. And one thing that Mr. Trump might be able to do that would make sense in this sort of situation, would be to require that any judge who has more than a set number of rulings reversed on appeal should have his or her appointment reviewed.
I cannot understand why Republicans in Congress aren’t holding nonstop impeachment hearings for judges violating the Constitution, Title IV and Title IX protections of American citizens. I get they have a lot of work to do on other fronts, but American women, minorities, white people & those who follow their religious beliefs are being relegated to the back of the bus (legally speaking) by far-left, radical, activist judges in violation of their rights. Americans suffered and died for those cherished freedoms and anarcho-communist judges are nuking them and p*ssing on the ashes.
Congress needs to remember for whom they work and the mission they were instructed to carry out by the citizens who voted for them.
Saw that a lot of that at Berkeley. The demonstrators would take over the ground floor, and the staff would take refuge upstairs. I had a girlfriend who worked there and showed me around. Eventually the university engineered a rooftop escape route for the staff. It wasn’t as precarious as it might sound, one could easily go from roof to roof on the buildings there.
Let’s hope that Judges Scarsi and Cronan are not only “Trump judges “, but more importantly: judges who rule “according to their souls and consciences” and nothing else – judges for whom Justice is the only consideration. Enough possibilities of conflict already exist between ‘the law’ and ‘Justice’ without adding other conflicting elements to the situation.
